General Terms of Use and Services – HOMEBAGS

Preamble

These General Terms of Use and Services govern all orders placed by Users:

By accepting a booking (via the site or the app), the Customer acknowledges having read and unreservedly accepted these Terms and Conditions in their entirety.

Publisher: HOMEBAGS, Simplified Joint Stock Company (SAS) with a share capital of €7,500, registered with the Cannes Trade and Companies Register under number 982 255 739, with its registered office located at 33 rue Du Pont Saint-Victor, 06400 Cannes (FRANCE).

Article 1: Definitions

Airport: Refers to Nice Côte d’Azur Airport (19 rue Costes et Bellonte, 06200 Nice), the luggage drop-off point covered by HOMEBAGS.
Application: Refers to all digital platforms and all technical and IT solutions accessible to Users (website, mobile app, back-office…).
Luggage: Refers to the Client’s belongings packaged by them and covered by HOMEBAGS’ services.
Client: Refers to any User making a booking on the Application and benefiting from HOMEBAGS’ Services.
Partner establishments: Refers to establishments (concierge, hotel, agency, etc.) that offer Clients access to the Application published by HOMEBAGS.
Services: Refers to the collection, storage, and delivery of the Client’s Luggage performed by HOMEBAGS teams.
Booking: Refers to any service order placed by the Client via the Application.
User: Refers to any person who connects to or browses the Application, whether or not they are a Client of HOMEBAGS.

Article 2: Acceptance of the Terms

Any connection to, browsing, or use of the Application requires full, express, and unconditional acceptance of these General Terms of Use and Services.

Article 3: Registration and login

Each User, after accepting these Terms and the Privacy Policy, may register by providing the following information:

Article 4: Purpose of the Application

The Application’s purpose is to allow Users to book luggage collection, storage, and delivery services provided by HOMEBAGS.

Article 5: Booking process

The Client can submit a Booking request by filling in the dedicated form via the Application to entrust HOMEBAGS with their luggage storage and transport.

Article 6: Booking cancellation

The Client may cancel their Booking via the Application if the cancellation occurs the day before drop-off before 12:00 AM. They will then be fully refunded within ten (10) business days to the bank account used for the booking.

Article 7: Booking modification

The Client may modify their Booking until 8:00 AM on the day their Luggage is collected.

Article 8: HOMEBAGS’ commitments and services

Once the Booking is confirmed and the Luggage is deposited at the Partner establishment, HOMEBAGS teams will take charge of the Client’s Luggage and guarantee its safekeeping and transport until hand delivery to the Client at Nice Côte d’Azur Airport.

Article 9: Deposit and nature of Luggage

The deposit is the act by which HOMEBAGS receives the Client’s Luggage, as depository. HOMEBAGS is obliged to safeguard the Luggage and return it in the same condition at the time specified by the Client in the Booking form.

Article 10: Luggage retrieval

To retrieve their Luggage, the Client must go to the drop-off point of the selected Terminal at Nice Côte d’Azur Airport at the time specified during Booking.

Article 11: Application access and security

HOMEBAGS makes every effort to ensure constant access to the Application. However, the service may be temporarily interrupted for maintenance or updates. HOMEBAGS cannot be held liable for interruptions beyond its control.

Article 12: User obligations

By using the Application and HOMEBAGS’ Services, the User expressly undertakes to comply with these Terms of Use and the Privacy Policy.

Article 13: Intellectual property

All content of the Application (texts, images, trademarks, logo, source code, databases, etc.) is the exclusive property of HOMEBAGS and is protected by intellectual property laws. Any unauthorized reproduction or use is prohibited.

Article 14: Exclusion

If HOMEBAGS finds that a User behaves unlawfully or violates these Terms, it may, after notifying the User, delete or suspend their personal account at its sole discretion.

Article 15: Liability and warranties

HOMEBAGS’ liability is limited to proven theft or loss suffered by the Client due to the Services, up to €1,000 (excluding optional coverage). HOMEBAGS cannot be held liable for indirect damage, loss of profit, or moral prejudice.

Article 16: Financial terms

All HOMEBAGS Service prices are indicated in euros, including VAT, in the Application and on the Website. For bookings made in the app, payment is made via in-app purchase (Apple Store or Google Play); for those made on the site, payment is made via Stripe, PayPal, or credit card on a secure page.

Article 17: No right of withdrawal

The Client cannot benefit from a right of withdrawal for their Booking, except if it is cancelled the day before drop-off before 12:00 AM (see Article 6). This clause also applies to orders placed in the app.

Article 18: Claims

In case of issues with HOMEBAGS Services (loss, delay, damaged luggage, etc.), the Client must contact customer service via the app (“Help / Claims” section) or by email at direction.homebags@gmail.com. A ticket or case number will be assigned for follow-up.

Article 19: Personal data

HOMEBAGS may process personal data concerning Users (name, postal address, email, phone, booking history, etc.) in accordance with its Privacy Policy and with the European GDPR. Users have the right to access, rectify, erase, and transfer their data via the Application or by written request to HOMEBAGS.

Article 20: Amendments

HOMEBAGS reserves the right to adapt or modify these Terms at any time. Any updated version will be published on https://www.home-bags.com/ and in the app. The date of the last update will always be indicated at the top of the document. Users are encouraged to consult the current version regularly.

Article 21: Force majeure

HOMEBAGS cannot be held responsible for failing to fulfil its obligations if a force majeure event occurs (strike, storm, general outage, IT failure, etc.).

Article 22: Nullity

If any provision of these Terms is declared null or void under current law or regulations, it will be deemed unwritten without invalidating the other provisions.

Article 23: Waiver

The fact that either PARTY (User or HOMEBAGS) does not enforce a clause of these Terms cannot be interpreted as a waiver of that clause in the future.

Article 24: Language

These Terms are written in English. In the event of discrepancies with any translation, the English version shall prevail.

Article 25: Governing law and mediation

These Terms are governed by French law. In the event of a dispute, the parties will attempt to reach an amicable agreement. If unsuccessful, any dispute will be submitted to the competent French courts, unless mandatory provisions state otherwise. The User may also resort to a consumer mediator free of charge.
